- Referring Party: an individual who is at least 18 years old who directly refers a Client to Verengo.
- Client: A person that may be eligible to enter a Sales Contract.
- Sales Contract – A Verengo residential solar installation contract.
- Customer – A Client that has entered a Sales Contract with Verengo.
- Referral or Referred Party – A Client that a Referring Party refers to Verengo
- Qualified Referral – A Qualified Referral (1) is a Client that is not a customer of Verengo, or in discussions with Verengo regarding installing a System, or has been referred by another party, (2) is a homeowner in the state of California, and (3) schedules a consultation with Verengo.
- Installed Referral – An Installed Referral is a Referral that has entered into a Sales Contract and has had a System successfully installed and interconnected.
- System – A System is a Verengo solar photovoltaic (PV) system installed on a residence
- Referral Reward – This is the amount Verengo will pay for a Qualified Referral and an Installed Referral.
Referral Program Summary:
Individuals who refer Clients to directly to Verengo may qualify for Verengo’s Referral Program. Verengo will issue a $50 reward to Referring Parties for each Qualified Referral. When that Referral completes a system installation with Verengo, both the Referring Party and the Referred Party will be issued a $350 reward. To qualify for the Program's reward, Referred Party must schedule their consultation, or install their solar system, with Verengo within one calendar year from date of referral submission.
Verengo will make all determinations regarding participation in the Program. Verengo reserves the right to terminate your participation in the Program or cancel the entire Program at any time for any reason or no reason, to the extent permitted by law, upon written notice to you. Any written notices required or permitted to be given by Verengo hereunder may be delivered by email to the email address we have on file for you. By participating in the Program, you consent to delivery of all Program-related notices and information by email to the email address you have provided when registering for the Program, and acknowledge that you have the necessary equipment (hardware and software) to receive and read such emails.
A Referring Party cannot refer themselves, or someone living in the same address as themselves. If a Referral contacts Verengo directly to inquire about Verengo's products and services, the Referral must mention being referred and provide the name and phone number of the Referring Party during the initial discussion with Verengo in order for the Referral Reward to be honored. Referring Parties will not be assigned to a Client or Customer retroactively after discussions for Verengo's products and services have begun. Referral Program reward offer cannot be combined with any other offers or promotions.
Verengo Complies with the federal CAN-SPAM, DNC and Telephone Consumer Protection Act. Therefore, it is beneficial for the Referring Party to invite their Referral to contact Verengo directly and mention being referred, providing all necessary information for both parties to be eligible for the Referral Program.
Reward Processing (Payments):
$50 rewards for Qualified Referrals, and $350 rewards for Installed Referrals will be processed monthly via check.
Verengo is not responsible for I) delays in executing an installation contract with Client, II) Client not meeting the requirements to install a solar system, III) Client not meeting the credit requirements to finance or lease a system, IV) delays do to wrong information provided by Referring Party or Referral, or V) mailing delays after checks have been processed.
Once the cumulative amount paid reaches $599.00, additional reward payments will not be processed until a completed W9 with correct recipient address is received. It could take up to 30 days from receipt of the W9 to process successive reward.
CAN-SPAM Act Compliance:
Verengo complies with the federal CAN-SPAM Act and honors requests of consumers and customers who choose to opt out of receiving Verengo marketing emails. Accordingly, if the Referral has previously opted out of receiving Verengo marketing emails, you will be advised that the email address is not eligible to be sent a Verengo Referral email.
DNC and TCPA Compliance:
Verengo complies with the National Do Not Call Registry, and with the Telephone Consumer Protection Act to the best of its ability. Referrals will not be contacted if they are on the Do Not Call Registry or you have provided a cell phone number which we cannot call, resulting in a disqualification.
Independent Contractor Relationship
Your participation in the Program does not authorize you to act on Verengo’s behalf. Nothing herein is intended or will be construed to constitute or imply a joint venture, employer-employee relationship, partnership or association between you and Verengo. By participating in the Program, you acknowledge that you do so at your own risk and as an independent contractor and that Verengo is not directing how you perform your obligations hereunder. You are solely responsible for making any disclosures required by law, including disclosing the possibility that you may receive a Referral Reward. You will not make guarantees of savings as a result of conducting business with Verengo, solicit door-to-door either to residents or businesses, or represent yourself as a representative of Verengo. Providing referral contact information to Verengo will serve as authorization for Verengo to contact the Referred Party. You are solely responsible for the information you share with Verengo and the implications of sharing that information, including but not limited to privacy policies and responsibilities between you and the person you refer.
Other than with respect to materials provided to in connection with your participation in the Program, your status as a participant in the Program does not entitle you to use any trademarks, copyrighted materials, patents, names, logos or other intellectual property owned or licensed by Verengo.
You are not allowed to use, register, or attempt to use or register Verengo or any of Verengo’s trademarks, product names, service names, service marks, or any derived of the foregoing, for any Internet domain name, email address, social media handles, or online aliases. Additionally, you cannot use or register domain names, email addresses, social media handles, and/or online aliases that could cause confusion, or be misleading or deceptive, in that they cause individuals to believe or assume the communication is from, or is the property of Verengo. Examples of the improper use of Verengo include, but are not limited to any form of Verengo showing up as the sender of an email or examples such as:
By participating in the Program, you agree to and will indemnify and hold Verengo, its shareholders, directors, officers and employees harmless from and against any and all damages, costs, expenses, claims or liabilities of any kind, including third party claims, whether pending or threatened, including without limitation, attorneys' fees and court costs, incurred by any of them arising out of or related to your participation in the Program or breach of these Program Terms and any applicable laws.
Warranty Disclaimers; Limitation of Liability
You expressly agree that your participation in the program is at your own risk. The program is made available to you on an "as is" basis without warranty of any kind, express or implied. Neither Verengo, its shareholders, officers, directors or employees, through these program terms, makes any warranty regarding the program, and each expressly disclaims all warranties, express or implied, including without limitation warranties of merchantability or fitness for a particular purpose. In no event shall Verengo, its shareholders, officers, directors or employees be liable for special, indirect, consequential or incidental damages or damages for loss of profits, revenue, use, or data as a result of claims, whether brought in contract or tort, arising out of or connected with these program terms or the program, even if Verengo has been advised of the possibility of such damages.
WHAT BASIC INFORMATION DOES THE COMPANY COLLECT?
We collect all the information you provide either as a Referring Party or you submit for prospective Clients which includes your name and that of the Referred Party, e-mail addresses, phone numbers, address and other contact information.
WHAT DOES COMPANY DO WITH INFORMATION SUBMITTED BY REFERRING PARTIES?
Referring Party Information:
We may share your personal information with third parties without further notice to you, to provide you with the rewards you earned for the Qualified Referrals you provided under the Referral Program or to comply with the law. We may also use your contact information to provide you information of any changes to the Referral Program. We may share information with third parties on an as-needed basis for the purpose of installing a solar system or offering the Client other energy saving products.
Referred Party Information:
We use the information provided by the Referring Parties to contact Clients from time to time about the benefits of installing a solar system and such other services and opportunities we feel may be of interest to the Client. We may share information with third parties on an as-needed basis for the purpose of installing a solar system or offering the Client other energy saving products.
DISCLOSURE OF INFORMATION
We may disclose personal information if required to do so by law or in the good-faith belief that such action is necessary to (1) conform to the edicts of the law or comply with legal process served on Verengo, (2) protect and defend the rights or property of Verengo or its customers; or (3) enforce this Policy. We do not rent or sell the information that was provided to us as part of the Referral Program.
